The Big Chimp Pvt. Ltd. ("Company"), which has its registered office at Chandan Nagar 2nd Line, Lanjipalli, Berhampur, Odisha - 760008, and Necteromni Technology Pvt. Ltd., which has its office at 1st Floor, Shining Villa, Jagamara, Near Barabari Line, Khandagiri, Bhubaneswar, - 751013, jointly own and operate the following Terms and Conditions apply to all uses of this website, and such use indicates recognition and acceptance of such Terms and Conditions ("Terms"). Before using any of the services offered by the Site, all Site Members are required to have read the following Terms carefully, to fully understand them, and to agree to them in their entirety ("Services"). Only those people who can enter legally binding contracts under Indian law are eligible to use the Services. By publishing the updated terms on this website, Big Chimp Pvt. Ltd. and Necteromni Technologies Pvt. Ltd. are free to change these terms at any moment. As soon as it is posted on this website, the modified version will instantly take effect.

Definition Clauses:

In the Agreement, as specified below, the following terms shall have the respective meanings:

DATE OF ACTIVATION: When placementodisha.com notifies a member by email or other means that their registration for the Service has been approved and granted access, such date is referred to as the "DATE OF ACTIVATION."

EXPIRY DATE: Is referred to as the day on which the notice of service termination expires.

MEMBER: Any person who accesses the Site for any reason is a MEMBER, regardless of whether they have registered as a registered Member with placementodisha.com or whether they have paid for a particular service offered by the Site. Anybody who accesses any material on this site while using it qualifies as a member.

• Member who desires to receive emails and online advertisements, bulletins, and promotional communications from PlacementOdisha.

REGISTRATION DATA: The term "REGISTRATION DATA" refers to all the details about the Member that were asked during the original application and subscription process, including but not limited to the Member's name, mailing address, email address, account, and phone number. Both the singular and plural forms of the terms are acceptable, and those that imply one gender must also imply the other., Berhampur, Odisha - 760008, and Necteromni Technology Pvt. Ltd., which has its office at 1st Floor, Shining Villa, Jagamara, Near Barabari Line, Khandagiri, Bhubaneswar, - 751013, jointly own and operate it.

Member's Obligations:

• The Member acknowledges and agrees that in order to use the Service, the Member is entirely responsible for the correctness and completeness of the Registration Data and other information submitted to the Company in the membership application. The Member is responsible for making sure that placementodisha.com does not receive any information that is fraudulent, false, misleading, or altered.
• The setup or configuration of the necessary hardware required to access the Service is the Member's responsibility.
• The Member agrees to abide by any notifications or instructions the Company may issue from time to time about the usage of the Service.
• The information that the Member retrieves, stores, or transmits using the Service is his exclusive responsibility.
• The confidentiality of the login information is the sole responsibility of the Member.
• This would comprise the member's username and password as well as all of the member's actions and transmissions on placementodisha.com.
• Any unauthorised use of the Member's account or any other security breach that the Member becomes aware of must be reported to the Company right away.
• The Member will make prompt payment of the Subscription Fees as needed by the Business.
• The Member will take all necessary precautions to maintain the confidentiality, including without limitation periodically changing his password.
• If you decide to stop working with us, you can remove your account by completing the delisting process using the Remove Account link that is available in your folder.  
• By this registration, you consent to receiving communications (via Calls, Chat, Mails, or SMS) on the subscribed services of placementodisha.com, Big Chimp Pvt. Ltd, Necteromni Technologies Pvt. Ltd. on the numbers provided during registration or thereafter, regardless of being on the Do Not Call Registry.

Commencement of Service:

• After we have gotten the required payment, the Service will start on the Day of Activation.

Proprietary Rights in Content on placementodisha.com:

• In addition to the services, placementodisha.com also owns and holds other proprietary rights in the website. The Website contains placementodisha.com's private information, trademarks, and copyrighted content. Any such proprietary information may not be copied, modified, published, transmitted, distributed, performed, displayed, or sold, except for information that is in the public domain or for which you have been granted authorization.

Intellectual Property Rights:

Prohibited Use:

• The Member will only permit the person(s) mentioned in the application form who are permitted to use the Service.
• The Member must only use the Service for the intended use for which it was purchased.
• The Member agrees to abide by all applicable laws and not violate any Indian laws that may be relevant to the Services, including any regulations imposed in accordance with such laws.
• The Member is forbidden from using the Service for any illegal purposes, including but not limited to illegal criminal ones.
• The Member is not permitted to transmit or receive any messages that are offensive on moral, religious, racial, or political grounds or that are vulgar, obscene, malicious, or menacing in nature with the Service.
• The Member is forbidden from repeatedly messaging other members or third parties who visit placementodisha.com without a valid purpose, or from making posts on the website with the intent to endanger, harass, annoy, irritate, or cause worry in any person.
• It is against the law for a member to introduce into the Internet or the placementodisha.com network system any data or software that:

a) Include a virus, worm, or other destructive component.

b) Violating someone else's intellectual property rights, or doing something similar like keeping information on a computer system.

c) Is illegal or that could be interpreted as abusive, defamatory, libellous, hurtful, threatening, harassing, vulgar, obscene, or otherwise objectionable based on race, ethnicity, or other factors.

e) Violates any copyright, patent, or trademark rights

• In the case of a violation of any of the above-mentioned covenants by the Member, and same comes to the Company's knowledge, the Company shall have the right to delete any material relevant to the violations without prior notification to the Member. If the Member continues with any activity that results in the violations, the Company shall issue a warning to the Member to stop doing so. If the Member persists, the Company shall have the sole authority to terminate or suspend the Member's membership at placementodisha.com and/or any other related facility. In addition to the right to indemnity that is available to the Company, the Company shall have the right to pursue any available legal remedies against the Member in order to recover the loss that the Company incurred as a result of the Member's violation and the damage that was done to the Company's goodwill.

Copyright Policy:

• Any copyrighted content, trademarks, or other proprietary information may not be posted, distributed, or reproduced in any way without the owner's express written authorization. Payment and Refund Policy:

• Payment for memberships: Only "Big Chimp Pvt. Ltd" & “Necteromni Technologies Pvt. Ltd.” may be designated as the beneficiary of any payments made for services at placementodisha.com. For uninterrupted use of Premium Services, all payments must be made in full ahead.
• We have not given anyone the go-ahead to collect payments for any services provided by placementodisha.com under any other name (i.e., under the name of another person or organisation), via personal bank account. You should be aware that placementodisha.com will never be held responsible for any harm resulting from transactions or payments you make to or on behalf of dishonest people or businesses. If any such dishonest person or business tries to deceive you, please get in touch with us.
• Even if the Member challenges the Subscription Fees for whatever reason, the Member is nevertheless required to pay them immediately upon demand. If the Company decides the disagreement is in the Member's favour, the Company will give the Member an interest-free refund of any excess amounts they paid. The Membership and the services would end if the Member paid any amounts due under this Agreement after the due date.

Money-Back / Refund Policy:

The payment made by the Member for a paid service is not refundable after it has been subscribed to, and no request for a refund will be granted. placementodisha.com does not endorse any of the content submitted by other Members and makes no claims as to its accuracy, timeliness, or originality. All services are provided with the utmost care.

• Reimbursement based on erroneous transactions:

The Member is fully accountable for upholding confidentiality in all transactions made through his My Folder, including all transmissions. Any offline or online transaction involving credit cards, debit cards, or other types of instruments or documents for conducting such transactions must be completed by him or her alone. placementodisha.com disclaims all duty and obligation for their unauthorised use of the subscriber's credit cards or debit cards, whether they were used online or off.

• Reimbursement based on preference change or processing delay:

There is no provision for a full or partial refund because placementodisha.com maintains strong relationships with its clients and conducts the entire process with their agreement.

Orders cannot be cancelled after they are placed since they are processed right away. Your personal preferences changing over time is not a valid justification for a refund or chargeback.

Confidentiality:

• Subject to prior identity verification, the Member has access to his own data and information that is kept in the database at PlacementIndia.com and is free to alter or amend it whenever necessary.
• The Members should be informed that if they choose to provide identification-oriented information (name, email address) in chat and bulletin board areas, that information may be acquired by a third party, leading to unsolicited messages from third parties. placementodisha.com has no control over or accountability for such interaction. In response to any legal actions, including but not limited to court orders, notices, subpoenas, FIR, etc., placementodisha.com is obligated to give all information that is available to it.

Maintenance of Services:

• Without providing notice, the Company may at any time disable or suspend the Member's use of placementodisha.com and/or the Services (as applicable) in order to perform system upkeep, testing, upgrades, repairs, and other related tasks. The Company shall not be liable for any loss and damage, costs, and expenses that the Member may suffer or incur, and no fees or charges payable by the Member to the Company shall be reduced, refunded, or rebated as a result of such deactivation or suspension, without limiting the other provisions of this Agreement.

Modification To Service:

• With or without giving the Member prior notice, the Company maintains the right to change or stop providing the Service. If the Company decides to use its right to change or end the Service, it will not be held responsible to the Member or any other person.

Suspension of Service:

• The Company may suspend the Service it offers without affecting any other rights or remedies it may have.
• When the Service is suspended, it is presumed to have been terminated as of the date specified by the Company, and the Member is responsible for any fees and charges incurred up to that point.
• If a member places an order, placementodisha.com maintains the right to block the membership.
• Materials that are offensive, abusive, threatening, vulgar, defamatory, or libellous are examples of objectionable content.
• Several profiles, such as: Each job posting is only permitted one profile.
• Fake contact information includes any type of email address, phone number, postal address, or other form of contact information.

Termination of Service:

The Company may end this Agreement immediately, without giving the Member prior notice, and without affecting any of the Member's other rights:

• If, in the Company's judgement, the Member has violated any clauses or requirements of this contract.
• If, in the view of the Company or any regulatory body, continuing to provide the Member with the Service is not in the best interests of the public.

The following could be used as justification for stopping the services:

• Harasses or encourages the harassment of another person: It is blatantly offensive to the online community; advocates racism, bigotry, hatred, or any form of physical harm against any group or individual; involves unsolicited mass mailings or "spamming," the sending of "junk mail," or "chain letters; promotes any misleading, false, or illegal information; or conduct that is abusive, threatening, obscene, defamatory, or libelling; encourages the unlawful or illegal use of another person's copyrighted work, for as through disseminating links to or pirated computer programmes or by offering information to get around manufacturing restrictions.

• Implemented copy-protection technology: Comprises pages that are password-protected or password-restricted, or hidden pages or pictures (those not linked to or from another page that is accessible);displays any sort of pornographic, obscene, or sexually explicit content; offers advice on any criminal activity, including invasions of privacy, the manufacture or purchase of illicit weapons, the distribution or creation of computer viruses, or hacking;placementodisha.com also reserves the right to suspend or terminate the services if it is discovered that they are not being used in accordance with the stated instructions or as the case may be. This includes asking other users for their passwords or other personally identifying information for commercial or illegal purposes.

Disclaimer:

• The Company is not responsible for any information loss, regardless of how it occurred, including loss due to interruption, suspension, or termination of the Service, as well as loss due to acts of God, natural disasters, virus/system attacks, hacking, or other causes. The Company is also not responsible for the accuracy or quality of information made available, received, or transmitted via the Service.
• The Member is completely responsible for making sure that when using the Service, all applicable laws, rules, and regulations for the use of systems, service, or equipment are always followed. In no way is the Company responsible in any way for this.
• For the Services and regarding the accuracy or quality of any information provided or accessed through the Services of placementodisha.com, the Company makes no express or implied representations or warranties of any kind.
• In no circumstances may the Company's responsibility under this Agreement exceed the sum of all fees and charges paid by the Member to the Company during the two month period immediately preceding the incident giving rise to the applicable claim.
• The Company is not responsible for any loss or damages resulting from the disclosure of any information about the Member's account or personal details, whether intentionally or unintentionally, or for any error, omission, or inaccuracy about such information.
• The Company makes no representations or warranties regarding the qualifications, standing, or reliability of any prospective employer or organisation that contacts a member after downloading their resume or after accessing the material or data they have provided.
• The Company does not guarantee that placementodisha.com or any of the websites linked to it will operate without interruption or be free of malware such as viruses or worms.
• The Member recognises that it is not the Company's policy to exert editorial control over, alter, or amend any data or contents of emails or postings, or to add, make public, or transmit to a third party any information contained in or sent through placementodisha.com. Any artwork, materials, information, or content of any data or information or posting may be refused, suspended, terminated, deleted, or amended by the Company if the Company determines that doing so will enable it to comply with its legal or moral obligations and will prevent it from violating the rights of third parties or any other rules, standards, or codes of conduct that may be applicable to the posting, placementodisha.com, or the internet.
• The member is solely responsible for updating their own résumé or other submitted information.
• Whenever the member submits their resume or other material, placementodisha.com makes no promises or guarantees that they will receive a favourable answer or even one at all.
• The member is solely in charge of determining the veracity of each response they receive as well as any information they see presented. Since it is a public website with open access, placementodisha.com disclaims all responsibility for the accuracy and sincerity of the responses.
• placementodisha.com makes no assurances or warranties on the qualifications of the potential employer, consultant, or business that downloads the data and contacts the site's members, including potential employer, consultant, visitor, or member.
• If you choose paid services, they will only start once payment has been received. After jobs or resumes are displayed, forwarded, or emailed, the service is considered given regardless of the response received.
• placementodisha.com employs a tried-and-true automated system for forwarding and search, but disclaims all warranties—express or implied—about the Services and their accuracy and suitability.
• Job-related material is submitted on placementodisha.com by Employers, Recruiters, and Consultants that have registered with the site. By gathering pertinent data from various websites, including the State & Central Government official websites, it also posts a few extra positions, including government employment. Links to the original source that display these Employment Details must be provided to the Member. These job posts and links have only been posted for the members' convenience and not for any financial or commercial advantage. placementodisha.com disclaims all liability for the accuracy of the job postings and their contents. Direct links to the portals, websites, and resources from which this information is gathered are provided by placementodisha.com to its members without the need for prior authorization. However, we do not allow any Member or Visitor to load, display, or copy our material for personal or professional use on their websites.
• placementodisha.com makes no representations about any such jobs or Member Content on the website and members are advised to exercise common sense and good judgement in this regard. placementodisha.com does not represent or guarantee the truthfulness, accuracy, or reliability of any such job postings, the ability of such Government employers to offer job opportunities to candidates, the ability of candidates to fill job openings, or any Member Content. In the actual transaction between employers and candidates, placementodisha.com is not a party. Any reliance on information provided on the website regarding openings should be at the exclusive responsibility of the Member.

Indemnity:

 You agree to defend, indemnify, and hold placementodisha.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand made by a third party due to or arising from your use of the Service in violation of this Agreement, a breach of these Terms of Use, or any breach of your representations and warranties stated above. This indemnification and hold harmless obligation apply to reasonable attorney's fees as well.

Variation:

The Member will receive notice of any changes (in the manner the Company may choose) to the terms and conditions included here and in the Services Guide at any time.

On placementodisha.com, the Terms and Conditions of this agreement shall periodically be amended. To examine the Terms and Conditions, the Member should periodically visit the website. To avoid any misunderstanding, the Member's continuous use of the Service is considered an affirmation and acknowledgement of the modified terms and conditions.

RSS:

placementodisha.com asserts ownership of all intellectual property rights, including copyrights, trademarks, and other rights, over the content that is made available through its RSS feeds. If the Members use RSS feeds downloaded from the website, they must mention placementodisha.com in some way.

Limitation of Liability:

As a result, it is not responsible for any loss or damage of any kind resulting from the use of its services or from a temporary or permanent suspension of those services. • As a public website with open access, placementodisha.com disclaims all responsibility for the calibre and sincerity of responses. placementodisha.com is unable to keep track of the feedback any Member receives in relation to the content they have contributed and that has been made visible on the website. Each Member should investigate the legitimacy of each response on their own (s). If any information on this website is inaccurate, placementodisha.com shall not be held responsible.
• placementodisha.com expressly disclaims all responsibility for any harm caused by the presence of false information on the website.
• The Member is advised not to share any personal, sensitive, or confidential information with any former or present employees of the business. The Member would act exclusively at his or her own risk, and placementodisha.com would not be responsible for any losses resulting from such a transaction of information, including but not limited to lost profits or savings, business interruption, loss of information, or damage to one's reputation.
• Given that mobile apps are made to be small and light to ensure a seamless experience, there may be some free and premium features that are included in the original website version but may not be included in the mobile application version. Each Member hereby certifies, warrants, and accepts that the foregoing is accurate, and no Member shall make any requests for the inclusion of any such feature in the mobile app version.
• By signing this agreement, the Member accepts full responsibility for conducting thorough investigation before using any material on the Site. Any loss or damage of any kind resulting from the use of, or the temporary or long-term discontinuation of, placementodisha.com's services shall not be the responsibility of placementodisha.com. Notwithstanding anything to the contrary in the foregoing, placementodisha.com's liability to you for any reason and regardless of the form of the action shall in no event exceed the amount you have paid, if any, to placementodisha.com for the Service during the membership term.

Member Dispute:

• Your interactions at placementodisha.com are completely the responsibility of the Members, and placementodisha.com reserves the right, but is under no obligation, to monitor Member disputes.
• In connection with any transactions made over the Site, placementodisha.com will not participate in any legal proceedings between a member and another registered or unregistered Member. placementodisha.com will always follow a ruling or legal authority's direction and cooperate fully throughout the procedure, but the costs of doing so must be paid for by the person who placed placementodisha.com in the middle of the dispute.

Matter of Disputes and Jurisdictional Aspects:

• All legal matters relating to placementodisha.com shall be handled only within the territorial jurisdiction of Bhubaneswar. Only Bhubaneswar-based courts have authority over all legal matters, and they only do so in accordance with the relevant current laws that are in effect there.

Governing Law and Jurisdiction:

• The Member and the Company hereby submit to the exclusive jurisdiction of the courts in Bhubaneswar, India about this Agreement and any dispute or matter arising from incidental use of placementodisha.com. This Agreement and any dispute or issue is governed by Indian law. The use of the Site and/or the Service constitutes your acceptance of this Agreement, which you further confirm by joining placementodisha.com. This Agreement constitutes the complete agreement between you and placementodisha.com. The remaining provisions of this Agreement shall remain in full force and effect even if one or more of them are found to be invalid.
